To the fullest extent permitted by applicable law, April Darley LLC disclaims applicable express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy.

9. THIRD-PARTY LINKS AND SERVICES

The Website may contain links to websites, resources, platforms, products, or services operated by third parties.

A link to a third-party website or resource does not necessarily constitute an endorsement by April Darley LLC. We do not control and are not responsible for third-party websites, their content, availability, security, products, services, policies, or practices.

Your use of third-party websites and services is subject to the applicable third party's terms and policies.

10. PURCHASES AND PAYMENT PROCESSING

The Website may allow you to purchase products or services from April Darley LLC.

Purchases may be processed through third-party payment providers, including Kajabi Payments, PayPal, and Square, as applicable. Payment methods made available through those providers may also be subject to the applicable provider's terms, conditions, and privacy practices.

You agree to provide current, complete, and accurate purchase and billing information and to pay all charges associated with purchases you authorize.

Individual products and services may also be subject to additional terms, agreements, policies, payment obligations, scheduling requirements, or other conditions disclosed at the time of purchase or separately agreed to between you and April Darley LLC.

11. REFUND POLICY

Refunds are handled according to the type of offer purchased and are also subject to the Refund Policy posted on the Website.

Digital Products

Digital product sales are final and nonrefundable.

If you experience a technical problem that prevents you from accessing a digital product you purchased, contact April@aprildarley.com so the access issue can be resolved.

Individual Sessions

Individual sessions may be cancelled for a refund before the scheduled appointment.

Cancellations made less than 24 hours before the scheduled start time are subject to a $50 cancellation fee, which will be deducted from the refund.

No refunds are provided for no-shows, cancellations after the scheduled appointment time has begun, or sessions that have already been provided.

Programs and Packages

For programs and packages, including Decode, a refund may be requested within 3 days after the first session.

Any refund will be reduced by the cost of the first session plus a 4% administration fee.

After the 3-day refund period, no refunds will be provided for unused sessions and any remaining program balance will still be due.

Nothing in this Refund Policy limits rights or remedies that cannot be waived under applicable law.

12. INTELLECTUAL PROPERTY

Unless otherwise stated, the Website and original content owned by April Darley LLC, including text, graphics, photographs, downloadable materials, digital products, educational materials, and other original content, are the intellectual property of April Darley LLC and are protected by applicable copyright, trademark, and other intellectual property laws.

Access to the Website does not transfer ownership of our intellectual property or grant you a general license to reproduce, publish, distribute, sell, sublicense, create derivative works from, commercially exploit, or otherwise use our protected content.

You may access and use Website content for your own personal, lawful, noncommercial use unless different terms accompany a particular product or resource or April Darley LLC gives you express written permission for another use.

Nothing in these Terms is intended to restrict any use permitted by applicable law.

13. NO PROFESSIONAL RELATIONSHIP

Use of this Website, including reading or accessing its content, resources, or communications, does not create a client or Personal Advising relationship with April Darley LLC.

A client relationship is established only when services have been expressly agreed to by April Darley LLC and the applicable agreement and payment requirements have been completed.

14. TESTIMONIAL DISCLAIMER

This Website may display testimonials, reviews, or client results. The results described are individual experiences and are not represented as results that every person will achieve.

Your results may differ, and no particular outcome is promised or guaranteed.

Testimonials are shared voluntarily, are not paid for, are used with permission, and reflect the experience of the person who provided them.

15. TERMINATION AND RESTRICTION OF ACCESS

April Darley LLC may suspend, restrict, or terminate your access to the Website when reasonably necessary because of a violation of these Terms, unlawful activity, misuse of the Website, threats to Website security, or other conduct that could harm April Darley LLC, the Website, or others.

Termination or restriction of Website access does not eliminate payment obligations, intellectual property protections, dispute-resolution provisions, or other provisions that by their nature should survive termination.

16. GOVERNING LAW

These Terms and Conditions are governed by and construed in accordance with applicable United States federal law and the laws of the State of Florida, without regard to conflict-of-law principles.

Except for matters properly brought in small claims court and matters subject to the binding arbitration provision below, any court proceeding permitted under these Terms shall be brought in a court of competent jurisdiction in Florida, unless applicable law requires otherwise.

17. DISPUTE RESOLUTION

Before filing a claim or initiating arbitration, you agree to contact April Darley LLC at April@aprildarley.com and attempt in good faith to resolve the dispute informally.

If the dispute cannot be resolved within 30 days, any claim or controversy arising out of or relating to these Terms, the Website, or a purchase from April Darley LLC, except a claim eligible for small claims court, shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under the applicable AAA Consumer Arbitration Rules.

Arbitration may be conducted by telephone, video conference, written submissions, or another method permitted by the applicable AAA rules and will take place in Vernon, Florida, unless the parties agree otherwise or applicable law or AAA rules require otherwise.

The arbitrator's decision will be final and binding, and judgment on the award may be entered in a court of competent jurisdiction.

Either party may bring an individual action in small claims court if the claim falls within that court's applicable monetary and subject-matter jurisdiction.

CLASS ACTION WAIVER: To the fullest extent permitted by applicable law, claims must be brought on an individual basis and not as part of a class, consolidated, collective, or representative action.

18. WAIVER

The failure of April Darley LLC to exercise or enforce any right or provision of these Terms and Conditions will not operate as a waiver of that right or provision.

Any waiver must be in writing and signed by an authorized representative of April Darley LLC.

19. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
